1° Movables and immovables shall be used according to normal and fair practice: any missing and/or damaged objects shall be replaced or paid for by the tenant. This clause shall apply to wallpaper, paints, curtains, upholstery, domestic appliances, bedding.
2° SECURITY: The tenant shall remit to the agency, an amount of 230 euros standing as security to cover the costs of any possible damages sustained by movables and immovables during occupancy, and to cover the costs of house cleaning as well as water, gas and electricity consumptions when such costs are not included in the price, and the costs of telephone communications where a telephone is provided. In no circumstances whatsoever shall this security be regarded as an advanced payment of the rent, or as an amount liable to BEAR INTERESTS, AND IT SHALL BE REIMBUSED TO THE TENANT WITHIN FIFTEEN DAYS AFTER TENANT LEAVES THE ACCOMMODATION

Should the security proved to be insufficient, the tenant hereby undertakes to complete the amount thereof. Collection and withholding of the security by the agency shall not be understood as an act involving the liability of the agency towards the owner concerning any and all damages liable to be caused by the tenant.
3° The accommodation is handed over to the tenant clean and in good condition, and shall be restituted in the same status. Any cleaning costs incurred in the event that the accommodation would not be restituted clean, will be charged to the tenant. The tenant shall be bound to replace the pieces of furniture and other objects at the places initially occupied.

4° The tenant shall pay, without compensation, any urgent repairs incumbent on the owner.
5° No objects liable to obstruct the piping systems shall be dropped or otherwise disposed of in the toilets, sinks, wash-basins etc., failing which the tenant shall be liable to the repair costs.
6° In case of tenancy in a co-ownership building, the tenants shall, as occupants of the accommodation, strictly abide by the co-ownership rules of the said building. It is expressly forbidden to hang linen from the windows.
7° Subject to cancellation, the tenant shall not sub-let or otherwise assign its rights without prior agreement of the lesser.
8° The accommodation is let without domestic linen.
9° The accommodation is let for a number of people corresponding to the existing bedding facilities. Any additional person shall be reported to the agency. The tenant who, without express authorisation, occupies the accommodation with a number of people in excess of the number stipulated (even temporarily) is in breach of the contract, hereby giving the agency the right to terminate the contract forthwith without any compensation whatsoever.
10° Rental periods run from Saturdays 16 h 00 until Saturdays 10 h 00.
11° Any cancellation of this agreement shall be notified to the agency by acknowledged registered letter.
The tenant shall be fully reimbursed for all the amounts paid at any time, if the cancellation results from any of events below :
- Serious illness, accident, severe injuries, death of the tenant or tenant's spouse or recognized concubine, or their ascendants or descendants,
- Death of a brother, sister, brother in law or sister in law.
- Complications resulting from pregnancy prohibiting any displacement during the month preceding the scheduled date of entry in the accommodation let.
- Inability to take possession of the accommodation let further to redundancy or transfer of the tenant, its spouse or recognized concubine, subject that employer's notification be posterior to the date of reservation.
- Fire, explosion or acts of god causing significant damages to tenant's primary home or vacation home, or professional site, arising prior to tenant's departure and imperatively requiring his presence on the site of the damages at the scheduled date of departure.
- Cancellation of the tenancy by the owners or their assignees, further to the death of the owners, or further to partial or total destruction of the accommodation let, and resulting from an event of whatever nature.
Beyond the above stated reasons, if the notice of cancellation is received :
- more than 30 days before the scheduled date of occupancy, the down payment can only be reimbursed at the pro-rata of a new rental (the accommodation being then let under the same terms) and in case of force majeure (illness, death, accident)
* between 30 and 15 days, the down payment will be retained by the agency
* between 15 and 3 days, the down payment will be retained by the agency and the tenant undertakes to pay an additional amount of 25% of the contractual price to the agency.
* Less than 3 days, the tenant shall pay the totality of the rental amount.
12° The tenant hereby undertakes to subscribe to an insurance policy covering : "Third party liability, private life with, in particular coverage of fire risks + water damage in case of trip of vacancy", and shall provide the evidence of such policy upon request.
13° By express convention, it is agreed that any dispute arising from these conditions shall be of the exclusive jurisdiction of the Courts of Les SABLES D'OLONNE.
